Incorporation of VBO Tickets Terms and Conditions
VBO Tickets (“VBO”) is the CRM software provider used by the St. Norbert College Box Office (“BOX OFFICE”). VBO’s Terms and Conditions, and all its future forms are incorporated with all BOX OFFICE agreements/contracts and all St. Norbert College Event agreements/contracts that contain box office services issued by the St. Norbert College - Division of Visual and Performing Arts. In addition to the BOX OFFICE, each LESSEE/CONTRACTEE is bound by VBO’s policy. VBO’s Terms and Conditions policy, as it was at the time of this document’s creation, has been merged with the BOX OFFICE’s policy to create one unified Terms and Conditions policy and is stated below for reference.
St. Norbert College Box Office and VBO Tickets Terms and Conditions Overview
Our goal is to make your purchasing experience easy, efficient and equitable, so we can get you on your way to live events as quickly as possible. The following is designed to ensure your satisfaction and understanding of the SNC Box Office and VBO Tickets in-person and online purchase process. If you have any questions, please contact us. Your purchases on our sites and applications are subject to these terms.
This document governs your relationship with VBO Tickets ("VBO”) and the St. Norbert College Box Office (“BOX OFFICE”). The following are the contractual provisions that govern your rights and obligations with regard to your purchase and use of event tickets ordered through VBO/BOX OFFICE. By clicking the “I ACCEPT THESE TERMS AND CONDITIONS” button, you signify your agreement to be bound by all of the provisions contained in this document (“User Agreement” or “Agreement”). For the purposes of this agreement, a "ticket" can mean a ticket, voucher, coupon, code, discount, seat, spot, registration, donation or any other merchandise item the BOX OFFICE may be contracted to sell.
Agency
VBO acts as an agent for the BOX OFFICE that is serving the event for which you purchase tickets. BOX OFFICE acts as an agent for off-campus, community presenters ("Event Provider” or “Promoter”) in addition to selling tickets for St. Norbert College (“SNC”) on-campus, internal presenters ("Event Provider” or “Promoter”). When you purchase a ticket for an event, VBO/BOX OFFICE will accept payment from you on behalf of the Event Provider. Any tickets you purchase will be sent to you from the United States, regardless of where you are when you place your order over the Internet. You agree that all ticket sales will be deemed to take place in the State of Wisconsin regardless of where you may be when you transmit your order through the World Wide Web.
Ticket Prices
The BOX OFFICE and VBO sell tickets on behalf of promoters, event providers, teams and other clients. The BOX OFFICE and VBO do not set the ticket prices or determine seating locations. The BOX OFFICE controls the number of seats available in any venue owned and operated by SNC based on venue capacity and/or other legal regulations. BOX OFFICE tells VBO what tickets it has available. The Promoter tells BOX OFFICE the price of each ticket. Each time a ticket is ordered through VBO/BOX OFFICE, the pool of available tickets is immediately reduced by the amount of tickets sold and payment is held for distribution to the Promoter. All ticket prices are in U.S. Dollars.
Availability
Tickets are generally sold through several distribution points, including online, by phone, and at the box office. All distribution points access the same ticketing system and inventory. Therefore, tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, we do not control this inventory or its availability.
Limitation on Number of TicketsWhen purchasing tickets through VBO/BOX OFFICE you may be limited to a specified number of tickets for each event (also known as a "ticket limit"). This ticket limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. Each patron’s account must be linked to a unique individual and contain valid, verifiable, information. Multiple accounts may not be used to circumvent or exceed published ticket limits. We reserve the right to cancel any or all orders and tickets, in addition to prohibiting your ticket purchase abilities, without notice to you, if you exceed or attempt to exceed the posted ticket limits. Any tickets, canceled due to violating the posted ticket limit, will be refunded at face value (possibly excluding fees). This includes orders associated with the same name, e-mail address, billing address, credit card number or other information.
Multiple Browser Windows
When ordering tickets online with us, please ensure you are looking for tickets and placing an order using only one browser window. Looking up tickets using multiple browser windows could result in losing your tickets, errors occurring during the purchase process, or timer expiration.
Service Charges, Handling or Facility FeesTickets purchased are subject to a ticket service charge or convenience fee. In some cases, delivery/handling fees will also be owed. All tickets for those events held in the Walter Theatre, Webb Theatre or Birder Hall are subject to a $1 per ticket facility fee. The facility fee is used to improve and enhance the continued use of these facilities. Ticket prices and all applicable fees will be as shown in the “check out” screen after you have chosen your items.
Methods of Payment
The BOX OFFICE accepts several methods of payment to accommodate your needs, including Cash, Check, Money Order, Gift Cards issued by the BOX OFFICE, SNC Account Requisitions, SNC Custom Cash, SNC Meal Dollars (on qualified purchases), American Express, MasterCard, Visa and Discover. During your purchase, you will be required to accept all terms and conditions before completing your transaction. Orders are processed only after the name and billing address of the cardholder has been verified.
Order Confirmation
After completing your on-line order, VBO/BOX OFFICE sends you an email with your ticket purchase confirmation number and other information relevant to your purchase and the event. If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your VBO account or by calling the BOX OFFICE during regular business hours whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
Delivery of Tickets
Different delivery methods may be offered at the discretion of the BOX OFFICE. Delivery options depend on several factors, such as the location of the venue for the event, your location, and the amount of time between the date you place your order and the date of the event. Please carefully review the list of delivery methods offered during the purchase process and pick the one which you think will most likely meet your needs.
There are NO REFUNDS in the event of any late delivery of any tickets. Generally, one or more of the following delivery options, at varying prices, are available:
Standard Mail - The mailing of tickets is not available one week prior to any event date. For all ticket deliveries, please allow at least 7 business days. May be subject to convenience fees.
Print Your Own Ticket – Only available on events when Promoters authorize this service.
Will Call – Tickets left in Will Call can be picked up at any time during BOX OFFICE hours at the BOX OFFICE’s home location in Abbot Pennings Hall of Fine Arts on the St. Norbert College campus. Will Call tickets are also made available one hour prior to the event start time at the event location. Customers must bring a valid photo ID to claim tickets and the person picking up the tickets must be the owner of the credit card used for the purchase. If you would like to hold the tickets under a different name, the ticket purchaser must contact the BOX OFFICE to notify us of the will call name change.
Refunds/Exchanges
Before purchasing, please carefully look over the entire process and confirm the items in your cart before you decide to purchase. There are no refunds. All purchases are final once the transaction is completed. We may occasionally offer tickets at a discount after the original on-sale date and will not refund the difference between the original price and the sale price.
Seating maps are representative of a venue’s layout; however, they are subject to change at any time and refunds are not allowed if the map is updated or if additional seats/rows are added or seats change as a result of a venue change after purchase.
In the event you cannot attend an event, you have the following options:
- Patrons may exchange their tickets for a different performance date of the same event. A $3 fee per ticket will be applied to all exchanges. The exchange may not take place after the original performance date has passed.
- Patrons may transfer their tickets or registration to another party to use. The SNC Box Office must be notified of this change, preferably, via email at tickets@snc.edu. To transfer tickets to another patron, the BOX OFFICE must have possession of the tickets.
- Patrons may request their ticket purchase be converted into a tax-deductible donation to the presenting non-profit organization or to the St. Norbert Fund.
- Patrons may request their ticket purchase be converted into an account credit to be used for future events sold by the SNC Box Office. Account credits can only be used when ordering in person or via phone at the BOX OFFICE. Order requests using account credits will also be accepted via email only if the request is received a minimum of 48 hours prior to the event and if there is an adequate account credit to cover the cost of the tickets and fees. You will receive an email confirmation when your order has been processed. If you do not receive an order confirmation you should assume your order did not go through. Account credits cannot be used during the online order process.
You agree that you will not attempt to evade, avoid, or circumvent any refund restrictions listed in this agreement and you will not dispute or otherwise seek a "chargeback" from your credit card company. Should you do so, your tickets are subject to immediate cancellation, and we may, in our sole discretion, refuse to honor pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit future purchases from all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site.
If we issue you a refund for a ticket due to a canceled or postponed event, we will issue a refund of the ticket's face value paid (or, for a discounted ticket, then instead the discounted ticket price paid) and all service fees. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. If the refund cannot be returned via the original payment method a representative from the BOX OFFICE will contact you via email or phone to make alternate refund arrangements. We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a canceled or postponed event.
VBO/Box Office Errors in Pricing
If the amount VBO/BOX OFFICE posts on its Site for a ticket is incorrect for any reason, VBO/BOX OFFICE shall have the right to cancel that ticket (or the order for that ticket) and refund to you the full amount that you paid including all fees and charges. This will apply regardless of whether the error resulted from human error or a transactional malfunction on the Site or other VBO operated system.
Ordering Errors
Because VBO’s authority is strictly limited by the operations of the BOX OFFICE, VBO cannot offer refunds for customer ordering errors. Furthermore, VBO has no ability to audit the causes of customer ordering errors. BOX OFFICE is the customer service agent for sales conducted by BOX OFFICE or the Site provided by VBO.
Once an order is placed those tickets are removed from inventory and are not available for purchase by others. Before an order is complete the number of tickets and charges are shown in the cart and you are asked to review the order and accept it. Once you confirm and accept an order, there will be no refunds. All discounts must be applied at the time of sale. No discounts will be applied after the patron has confirmed their order and completed the sale. The BOX OFFICE will not exchange tickets into the discounted price after the order has been completed. All sales are final.
Lost or Destroyed Tickets
Once a ticket has been deposited in the mail or with a courier service or sent to you electronically, there will be NO REFUNDS even if the ticket is lost in transit, stolen, arrives late, or is destroyed. Tickets can be reprinted or re-issued by BOX OFFICE at the customer’s request. May be subject to a convenience fee.
Changes in Event Programming
Events often have more than one performer or type of entertainment. Usually, in these circumstances, there will be a main or headliner performer and others, generally described as “opening acts”. If the headliner’s performance is canceled, then refunds will be governed by the Promoter’s and BOX OFFICE cancellation policies. Opening acts are subject to change or cancellation at any time without notice. If one or more opening acts change or fail to appear, there will be no exchanges, refunds or discounts. No refund will be owed if an opening act is changed or canceled.
Canceled Events
An event may be canceled or postponed by the promoter, team, or venue operator due to weather, scheduling, or other unforeseen circumstances. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed events, please check the event information online or contact us in person, via phone or email. Our primary form of communication will be email. We recommend signing up for our newsletter and ensuring an email is associated with your account to be included in general information. Direct phone calls to patrons will be limited and only used when email communication is not possible. Information will be delayed if we are required to call a patron due to a lack of available email. The news outlets and our social media channels will also be alerted and used to spread the word. Refund and exchange policies are set by the BOX OFFICE, not VBO Tickets.
Due to the possibility of high phone traffic after an event cancellation, we highly recommend reaching out to us via email at tickets@snc.edu. The SNC Box Office may have to adjust business hours due to available labor or college recommendations so requests via email will give us the opportunity to respond in a timely fashion and in the order in which they are received.
VBO TICKETS/BOX OFFICE/SNC will NOT be liable for and will not pay or reimburse any travel, lodging, meals, or any other expenses that you or anyone else may have incurred in connection with a canceled or postponed event. It is also important to note that we will never ask for credit card information for sales that have already occurred. When dealing with a cancellation, we are merely trying to provide information for a rescheduling situation and the refund limitations/options or just to inform that an event is canceled and how the refund process is expected to play out.
Unauthorized Ticket Selling
No person or persons will link to this site or in reference to it for the purpose of selling tickets of any kind. We will investigate and take appropriate legal action and remove/bar such violators from use of this site. The BOX OFFICE and the promoters it works with reserve the right to cancel a ticket order, void tickets already purchased or limit access to any user known or believed to be associated with any ticket broker, scalper, or illegal venture. Individuals utilizing automated means to place ticket orders, or whose ticket order exceeds the stated limit will have their tickets canceled and access blocked to this site. In addition, we reserve the right to restrict or deny ticket purchasing privileges to anyone that we determine to be, or has been, in violation of our policies. Because we do not guarantee the authenticity of tickets purchased from any non-authorized third party reseller (such as brokers or individuals), we recommend that you purchase tickets directly through us, authorized partners or from the venue box office to ensure ticket authenticity. Tickets may not be used for advertising, promotions, contests or sweepstakes unless formal written authorization is given by us.
You are Subject to Search
You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, firearms, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles and containers.
License Ejection and Cancellation, No Redemption Value
You agree to comply with all of the Event Providers' applicable rules, policies, terms and conditions. Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider Rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket's face amount. A ticket is not redeemable for cash.
Recording, Transmission and Exhibition
You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to us, the Event Provider(s), our partners, licensees and assigns, including but not limited to our brand and media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
Limitation on VBO/Box Office/SNC Liability
Event-Related Injury or Losses
At sporting events, balls, pucks or other materials may enter the spectator area and cause an injury. There is always the possibility of fights, fires or other injuries causing occurrences. You hereby agree that VBO/BOX OFFICE/SNC will have no liability to you or any other ticket holder whose tickets were purchased through VBO/BOX OFFICE for any losses, damages, death or injury suffered in connection with the event.
Damages Limitation on Liability
In no event for any reason or cause under any legal theory will VBO/BOX OFFICE/SNC be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if VBO/BOX OFFICE/SNC has been advised of the possibility of such damages.
No WarrantiesVBO/BOX OFFICE/SNC does not promise that the site will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search or link on it. The site and its content are delivered on an "as-is" and "as available" basis.
VBO/BOX OFFICE/SNC cannot and does not ensure that material you may download from the site will be free of viruses or contamination or destructive features.
VBO/BOX OFFICE/SNC disclaims all warranties, express or implied, including disclaiming any implied warranties of merchantability or fitness for a particular purpose. VBO/BOX OFFICE/SNC will not be liable for any damages of any kind arising from the use of its sites or the purchase of any tickets to any events, including without limitation, no liability for direct, indirect, incidental, punitive or consequential damages. VBO/BOX OFFICE/SNC makes no guarantee of any specific result from use of its sites or use of the VBO/BOX OFFICE/SNC service or the qualities or characteristics of any event.
No Liabilities for Acts of Third Parties
VBO/BOX OFFICE/SNC disclaims any and all liability for the acts, omissions and conduct of any third parties, including but not limited to other ticket buyers, advertisers, sponsors on the site, or promoters in connection with the VBO/BOX OFFICE/SNC service, the event itself, or otherwise related to your use of the site and/or the VBO/BOX OFFICE/SNC service.
You agree that VBO/BOX OFFICE/SNC will not be responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with the sale of tickets, the use of the site, attendance at the event or cancellation of the event or performance for which the tickets are purchased.
Events are Controlled by Venue Owners and Event Promoters
VBO/BOX OFFICE acts only as a ticket selling agent of the event Promoter. All aspects of the event itself are controlled strictly by the Promoter, venue or other third parties. VBO/BOX OFFICE does not set ticket prices, the time or date of the event, the content of the event, the nature of the performance, type or arrangement of seating, availability of medical, security or other facilities, parking, access, transportation or any other aspect. Further, Promotes and venues set their own rules and regulations for attendance at events, including security policies, search policies, alcoholic beverage policies, ejection policies, refund, cancellation and rescheduling policies and the like. By purchasing a ticket through VBO/BOX OFFICE you agree that VBO/BOX OFFICE will have no liability for any such policies or activities on behalf of the Promoters or any third party and that any complaints you may have with regard to the event or its cancellation or rescheduling, its content or any other aspect of the event will be directed solely to the Promoter and/or the venue and NOT to VBO/BOX OFFICE and that VBO/BOX OFFICE will not be liable for any such complaints you may have.
A. Venue Owner's Rules and Regulations
Promoters and venue owners (“VENUE” or “VENUES”) often prepare their own rules and regulations concerning the conduct of events. All tickets sold by VBO/BOX OFFICE are sold with the understanding that the ticket may be used by the purchaser only subject to and in accordance with the VENUE’s rules and regulations. By purchasing a ticket through VBO/BOX OFFICE you acknowledge and agree that your purchase of the ticket and use of the ticket will be subject to those rules and regulations.
B. Recording of Events
Typically VENUES have a recording policy that prohibits the recording, transmission or reproduction of any description, account, picture, sound or other aspects of the event. Should you violate the VENUE’s rules prohibiting recording of an event you may be ejected and you may be subject to such other actions as the Promoter or VENUE may deem appropriate. Often the events themselves, including portions of the audience are recorded. By purchasing a ticket through VBO/BOX OFFICE you hereby grant permission to the Promoter and/or VENUE to utilize your image, likeness, actions or statements in any live or recorded audio, video or other photographic display or other transmission, exhibition, publication or reproduction made of or at the event, regardless of whether or not the recording took place before, during or after the performance. Such permission is granted for recording and transmission in any medium and without further authorization by you or compensation to you.
C. Ejection from Event by Promoter
Promoters and VENUES reserve the right, without any refund to you, to refuse admission to you or eject you if the Promoter or VENUE management considers your conduct to be obnoxious, vulgar, disorderly, abusive or disturbing or if the Promoter or venue management believe you have failed to comply with the Promoter’s or VENUE’s rules. Breach of the terms of the Promoter’s or VENUE’s rules and regulations will terminate your right to attend the event and will subject you to ejection from the event without a refund.
The Promoter/BOX OFFICE/VENUE considers the ticket to be a revocable license for admission to an event and admission may be refused and the license canceled for violation of the Promoter’s or VENUE’s rules. Further, the Promoter/BOX OFFICE/VENUE will have the right to cancel your ticket without cause and in such case, the Promoter/BOX OFFICE/VENUE’s only obligation will be to refund to you the ticket’s face amount. You have no right to redeem or cancel a ticket for cash.
D. Alcoholic Beverages and Prohibited Items
The VENUES’s rules and regulations typically prohibit alcoholic beverages, illegal drugs, weapons of all types, cameras, recording devices and other items. By purchasing a ticket through VBO/BOX OFFICE you understand and agree that your attendance at the event will be subject to the Promoter/VENUES’s rules and regulations, including being subject to the Promoter/VENUE’s policy prohibiting certain items and materials. If you attempt to bring prohibited materials into the event the Promoter/VENUE may seize them and/or may refuse you admission without a refund.
E. SearchesBy purchasing a ticket through VBO/BOX OFFICE you automatically become subject to the Promoter/VENUE’s rules and regulations which often include a search policy. By purchasing this ticket through VBO/BOX OFFICE you consent to the Promoter/VENUE’s rules, including giving your consent to searches and you waive any claims that may arise as a result of any such search. If you attempt to attend the event and refuse to allow yourself to be searched, the Promoter/VENUE may deny you entry to the event without refund or other compensation. Similarly, if during a search, prohibited materials such as alcohol, weapons, drugs, recording devices, etc., are found, the Promoter/VENUE may refuse you admittance without refund or may confiscate such prohibited materials.
F. Unlawful Attempts to Resell Tickets
Many jurisdictions and venues have “scalping” and other laws that define what an illegal resale of a ticket is. An attempt to illegally resell your ticket is grounds for seizure of the ticket and cancellation by the Promoter/VENUE/BOX OFFICE without compensation. A ticket purchased through VBO/BOX OFFICE may not be used for the purposes of advertising, promotion, contests or sweepstakes without the written authorization of the Promoter.
Indemnity
By purchasing a ticket through VBO/BOX OFFICE, you agree to indemnify VBO/BOX OFFICE/SNC and to hold VBO/BOX OFFICE/SNC and its officers, directors, agents, employees, contractors and principals, harmless from any loss, cost, liability, claim or demand, including reasonable attorneys' fees incurred by VBO/BOX OFFICE/SNC, in connection with any third party claim, demand or liability, which claim or loss is based on, related to or arises out of your use of the Site or your purchase of a ticket through the Site, or your attendance at the event for which the ticket was issued except to the extent that the claim or loss was due to the negligent or wrongful conduct of VBO/BOX OFFICE/SNC.
Jurisdiction and Venue for VBO Tickets
If you have a dispute and your dispute involves an event (or a ticket for an event) that is located in the United States, then the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions and you hereby consent to personal jurisdiction in the courts in Santa Clara County, California and you agree to bring all actions, exclusively in state and federal courts located in Santa Clara County, California.
If you have a dispute regarding the Site but not regarding an event (and not regarding a ticket for an event), then if you are accessing the Site from the United States you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions and you consent to personal jurisdiction and agree to bring all actions, exclusively in state and federal courts located in Santa Clara County, California
Jurisdiction and Venue for Box Office/SNC
If you have a dispute and your dispute involves an event (or a ticket for an event) that is located in the United States, then the dispute will be governed by the laws of the State of Wisconsin without regard to its conflict of law provisions and you hereby consent to personal jurisdiction in the courts in Brown County, Wisconsin and you agree to bring all actions, exclusively in state and federal courts located in Brown County, Wisconsin.
If you have a dispute regarding the Site but not regarding an event (and not regarding a ticket for an event), then if you are accessing the Site from the United States you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions and you consent to personal jurisdiction and agree to bring all actions, exclusively in state and federal courts located in Santa Clara County, California.
